Recommendations emerging from the break away group discussions on four different provisions of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003.


Topic for discussion for Group 1:

Provision 1- Ban on smoking in public places
Recommendations:-

Publicity of the Act

Enforcement officers/Agencies and NGOs should be empowered

Legal status for breach of Act

Each state High Court should be approached with PIL for enforcing the Act

Central Govt. should direct the states

Sign boards should be placed with punishment

Commitment for enforcing the law amongst people

Penalties from the management of public place

Displays in local language about the contents and to the non smokers along with the Act

Public movements

Taxis & Auto rickshaw & all public vehicles to be covered with information boards

Publicity materials to be arranged and distributed

How & its relevant to be displayed at all prominent places


Topic for discussion for Group 2:

Provision 2- prohibition on advertising, promotion and sponsorship of tobacco products
Recommendations:-

Implementation Problem

No awareness regarding the provision of the law

No suggestion of & awareness about provision among enforcement agencies

No action against indirect advertisement

Indirect sponsorships like – Godfrej Phillips Bravery Award in the name of corporate identity should be stopped

Indirect sponsorship in the name of tobacco brand like Wills Life Style Fashion show needs urgent attention of Ministry of Health

Tobacco companies selling corporate identity, ITC school Note Books to children, should be stopped, as it is indirect advertisement of the Brandname
